The Firm’s primary emphasis is on litigation, and since opening our firm in early 1995, we have tried over a dozen employment cases in either federal or state court, and prevailed in each case but one. Significant victories have been obtained for several of our larger clients, such as Intel Corporation, Delta Air Lines, Lockheed, BHP Minerals International, Inc., Philips Semiconductors, Philips Electronics, United Parcel Service, Inc., and American National Insurance Company. We also have obtained numerous outright dismissals short of trial, and a considerable number of very reasonable settlements. Our success over the past eight years is even more remarkable in light of the inherent difficulties present in employment litigation. Our general philosophy is to vigorously and aggressively defend against employment claims in order to avoid the type of “copy-cat” claims that often arise when an employer either loses a case, or agrees to unreasonable settlement demands.

The Firm also has an active practice in defending administrative charges before such agencies as the Equal Employment Opportunity Commission, the New Mexico Human Rights Division, the OFCCP, and the National Labor Relations Board. Gilkey & Stephenson handles other labor and union-related issues, including picket line activities, union membership questions, injunction issues, and collective bargaining agreement arbitrations. The Firm also provides loss-prevention services for its employer clients, including drafting or revising personnel policies, training of managers and employees, and pre-termination consultations.


 

Biographies:

Duane Gilkey

Mr. Gilkey has been practicing law for 40 years and has extensive experience representing local, regional and national employers in all phases of labor and employment law. His practice deals with all federal and state laws affecting the employer-employee relationship including employment discrimination, sexual harassment, wrongful discharge, federal contract compliance, occupational safety and health, wage and hour, unfair labor practices, collective bargaining and labor arbitration.

Mr. Gilkey has successfully defended employers in many employment discrimination, sexual harassment, wrongful termination and labor cases in state and federal courts. He has obtained favorable resolutions of over 500 employment discrimination charges before the U.S. Department of Labor, New Mexico Department of Labor Human Rights Division and Equal Employment Opportunity Commission and unfair labor practice charges before the National Labor Relations Board. His firm’s clients include Intel, United Parcel Service, Philips Semiconductors, Westinghouse, Lockheed, University of New Mexico and Delta Air Lines.

To assist the employer in avoiding expensive litigation, Mr. Gilkey emphasizes preventive counseling of the general manager and personnel manager to ensure appropriate administration of personnel policies. In that regard, his practice includes the presentation of seminars and workshops on topical employment law issues to his clients’ management personnel.

Barbara Stephenson

Barbara Stephenson has over twenty years of legal experience and, for the last twelve years has worked exclusively in employment law. Ms. Stephenson has defended several clients in Office of Federal Contract Compliance Programs (“OFCCP”) investigations and reviews, and also has handled a variety of other administrative claims faced by employers. Her practice currently focuses on employment litigation, defending administrative claims, and counseling clients in personnel issues. Since 1995, she has tried several cases on behalf of clients such as CUNA Mutual and Delta Air Lines. Defense verdicts were obtained in all cases. Ms. Stephenson is also a frequent lecturer on employment law topics.

Carol Dominguez

Carol Dominguez has seven years of legal experience, and joined the Firm in 1998 after practicing for two years at the Indiana firm, Baker & Daniels. Ms. Dominguez has a wide range of experience representing local, regional and national employers in all phases of labor and employment law. Ms. Dominguez is very active in the Firm’s preventative maintenance program and has conducted numerous audits of company employment practices. She also regularly counsels clients with emergency situations and has presented a number of seminars on employment-related topics to clients and other attorneys. In addition to successfully litigating cases and negotiating reasonable settlements, Ms. Dominguez has obtained outright dismissals (both voluntary and through motions practice) of plaintiffs’ claims. She has also achieved successful results against several different unions in arbitrations, has helped clients avoid unionization, and has participated in successful renegotiations of collective bargaining agreements.


George C. Kraehe

Mr. Kraehe joined the Firm in 2002, after practicing law as a Texas assistant attorney general, as a partner in a law firm in South Texas, specializing in the defense of governmental employers, and as an Army JAG officer for a tour of duty following 9/11. Mr. Kraehe, a graduate of Yale University and the University of Texas School of Law, has nearly 9 years’ experience representing local, regional, and national employers in all phases of employment litigation. He has first or second-chaired twenty jury and bench trials, has been lead counsel in over thirty appeals in state and federal courts, and has been directly involved in other substantial litigation matters. Mr. Kraehe is also active in counseling clients to achieve full employment law compliance, has prepared numerous employment policy handbooks, and has written and lectured widely on matters of interest to employers.
